What is the Judiciary Doing?

The hearing on gun control bill H.610 continued on yesterday and there is testimony scheduled for tomorrow.  But, the E-mail string below shows these committee hearings are testimony on a badly broken process.

Draft 6.1 of H.610 is [available here].  This is sixth and latest version of gun control bill H.610. H.610 is sponsored by Judiciary Committee Chair Maxine Grad (D) and Committee Ranking Member  Martin LaLonde (D) and this bill still violates “due process” rights of gun owners.

The gun rights representatives have known that since Maxine Grad has been the Chair of the Judiciary  Committee, that we have been treated as second class items, treated with disdain.  Chair Grad often gets up  and walks out of the room when our witnesses take the witness seat.

We frequently get handed a new draft of a bill, as we arrive to testify about the last published draft of a bill.

It is glaringly obvious that the witnesses supporting the gun control bill are well prepared for the new draft  and we believed they were involved in the writing of the new draft.

So, on Jan. 23, the Vermont Federation of Sportsmen’s Clubs filed a Public Records Request (PRR) to seek  information relative to what was happening with H.600 and H.610 in the House Judiciary Committee, outside  of the view of the public. We are still going back and forth with the legal staff over getting access to what records we want to review.

At 5:48 PM on Monday, after the end of the business day, we were sent Draft 6.1, of H.610 via E-mail.

But, included was an E-mail string that showed we were correct, that Reps. Maxine Grad and Martin LaLonde were working with lobbyist Sarah Robinson and other lobbyist(s) supporting their bill, in the crafting of these new drafts and sharing the new draft with the other gun control advocates of these gun control bills, well prior to our being allowed to even read the new Draft.

The E-mail string is down below. (Eric Fitzpatrick is a lawyer for the Legislative Council and Mike Bailey is  the Committee (Admin) Assistant)  Notice none of the other 9 members of the committee received the contents.

The Vermont Federation of Sportsmen’s Clubs has long been involved in the legislative process in Vermont. We understood and supported the committee process by which the legislature operates.  But, since Maxine  Grad has chaired the House Judiciary Committee, the committee has gone off the rails.  It is run with bias and disrespect for the advocates of gun ownership rights in our state.  This practice of injustice must stop.

You can tell Maxine Grad and Martin LaLonde that you demand the gun control bills that violate sound public policy and the Vermont Constitution and U.S. Constitution cease.  “Due Process of Law for All” Tuesday, February 18, 5 PM, House Chambers of the Vermont State House.

Hi all,

Attached is the revised draft of H.610, incorporating the recommended changes Sarah sent after the meeting last week. Note that the changes are shown in blue highlights, and the yellow highlights remain from the prior draft. Maxine, I think this actually worked well, so there isn’t any need for a separate clean draft yet.  

Sarah, can you please read the blue highlighted changes closely to make sure I have integrated them correctly? I did a bit of editing and rewriting for clarity and organization, but did not intend to change anything substantively.
